Terms of Service

By accessing the Platform, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional policies referenced herein. If you do not agree, please do not use the Platform.

You must be at least 18 years old and capable of entering into a contract under the Indian Contract Act, 1872 to use the Platform or place an order.

When you create an account, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.

All products are described and photographed as accurately as possible. However, minor variations in colour, texture, and finish may occur due to natural fibres, lighting, and monitor calibration.

Prices are listed in Indian Rupees (₹) and are inclusive of GST. Shipping charges, if any, are calculated and displayed at checkout. Prices are subject to change without notice; the price confirmed at checkout is the price you pay.

We reserve the right to limit quantities, discontinue items, and refuse orders. In the event of a pricing or stock error, we will contact you before processing the order.

Placing an item in your cart does not reserve it. An order is confirmed only after full payment is received and we send an order confirmation email with an order number.

We accept payments through Razorpay, supporting credit/ debit cards (Visa, Mastercard, American Express, RuPay), UPI, net banking, and popular wallets. EMI is available on select cards. We do not store full card details on our servers.

We may refuse or cancel an order if it appears to be placed by a dealer, reseller, or for fraudulent or unlawful purposes. In such cases, the payment will be refunded to the original method within 7 business days.

We currently ship within India. International shipping is not available at this time. Estimated delivery timelines are provided at checkout and begin from the date of dispatch (not the date of order placement).

Title and risk of loss pass to you upon delivery to the carrier. We are not responsible for delays caused by the carrier, weather, natural events, or incorrect addresses provided by you. Please refer to our Shipping Policy for full details.

Returns are accepted within the return window specified in our Refund Policy from the date of delivery. Items must be unworn, unwashed, and in original condition with all tags attached. Sale items, intimates, and customised pieces are final sale.

Cancellations are accepted up to 2 hours after order placement or until the order is processed, whichever is earlier. Refunds are processed to the original payment method within 7 business days of receipt and inspection of the returned item. Please refer to our Refund & Return Policy for the complete process.

All content on the Platform — including text, graphics, logos, images, videos, product designs, and software — is the property of Cottonclaas or its licensors and is protected by the Copyright Act, 1957, the Designs Act, 2000, and the Trade Marks Act, 1999. You may not copy, reproduce, republish, transmit, or create derivative works without our prior written consent.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Upload viruses, malware, or any code designed to disrupt the Platform.
• Scrape, crawl, or use automated means to access the Platform without our prior written consent.
• Impersonate Cottonclaas, our employees, or any other person or entity.
• Post reviews or content that are defamatory, obscene, hateful, or infringing on third-party rights.

The Platform and all products are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Cottonclaas shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid for the relevant order.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the Consumer Protection Act, 2019, or any other applicable law.

You agree to indemnify, defend, and hold harmless Cottonclaas, its directors, employees, and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Platform, or your violation of any applicable law or third-party right.

These Terms are governed by the laws of the Republic of India. Subject to the dispute resolution process below, the competent courts at New Delhi shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms.

We aim to resolve any concern swiftly. Please contact our Grievance Officer first at [email protected]. We will acknowledge your complaint within 48 hours and attempt to resolve it within 30 days.

If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat, venue, and language of arbitration shall be New Delhi, India and English. Consumers may also pursue claims before the Consumer Disputes Redressal Commission or the INGRAM online portal under the Consumer Protection (E-Commerce) Rules, 2020.

• Severability: If any provision is held invalid, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any right is not a waiver of that right.
• Assignment: You may not assign these Terms without our consent; we may assign them to an affiliate or successor.
• Entire Agreement: These Terms, together with the Privacy Policy and any order-specific terms, constitute the entire agreement between you and Cottonclaas.
